These Terms of Service ("Terms") govern your use of KandiForge and Kandi Companion applications ("Services") operated by Abstract Class Consulting Inc. ("Company," "we," "our," or "us").


Acceptance of Terms

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of these terms, then you may not access the Services.


End User License Agreement (EULA)

License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the KandiForge and Kandi Companion applications for your personal or internal business purposes.

License Restrictions

You may not:
• Reverse engineer, decompile, or disassemble the software
• Remove or alter any proprietary notices
• Use the software for any unlawful purpose
• Share your license with unauthorized users
• Create derivative works based on the software


User Accounts and Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.


Acceptable Use Policy

You agree not to use the Services to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit malicious code or harmful content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Services
• Use the Services for competitive analysis
• Generate content that violates third-party rights


Intellectual Property Rights

Our Content

The Services and their original content, features, and functionality are owned by Abstract Class Consulting Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Your Content

You retain ownership of any code, specifications, or content you create using our Services. You grant us a limited license to process your content to provide the Services. Generated code belongs to you, subject to any third-party libraries or dependencies used.


Payment Terms and Refunds

• Subscription fees are billed in advance on a recurring basis
• One-time license fees are non-refundable after the 7-day trial period
• We reserve the right to change pricing with 30 days notice
• Failure to pay may result in service suspension
• Refunds are provided according to our refund policy


Third-Party Services

Our Services integrate with third-party services including GitHub, Anthropic's Claude, and payment processors. Your use of these services is subject to their respective terms of service. We are not responsible for the availability or functionality of third-party services.


Data and Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Services, to understand our practices. You can request deletion of your data at any time by contacting support@abstractclass.net.


Service Availability and Support

We strive to maintain high availability but do not guarantee uninterrupted access. We provide support through our designated channels and will make reasonable efforts to address issues promptly. Support is provided during business hours (Monday-Friday, 9 AM - 5 PM PST).


Disclaimers and Limitations of Liability

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. OUR LIABILITY IS LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICES IN THE PAST 12 MONTHS.


Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason. Upon termination, your right to use the Services will cease immediately.


Apple App Store Terms

If you download our app from the Apple App Store, you acknowledge that these Terms are between you and Abstract Class Consulting Inc., not Apple. Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support services. Any product warranties are provided by us, not Apple. Apple is not liable for any claims relating to the app.


Governing Law and Dispute Resolution

These Terms are governed by the laws of [Your State/Country]. Any disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in class action lawsuits.


Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Services after changes become effective constitutes acceptance of the new Terms.
